How Covid 19 CoronaVirus is affecting volleyball?

by WoV

The whole world has been hit by an unknown virus called Covid 19 coronavirus. While almost all countries are trying to beat the evil, volleyball has fallen into the shadow of the Covid 19 pandemic that has been announced by the World Health Organization.

However, volleyball players and clubs have also been hit by this situation since the leagues have postponed all the games and everything.

Now, many clubs are considering the option to cut the salaries of the volleyball players and to reduce their costs since the worldwide competitions will probably not be completed.

Following the previous mentioned situation, it seems that FIVB and CEV will get many legal cases in 2020. Volleyball players and coaches will fight for their rights while the clubs will try to save their budgets.

WorldofVolley have asked the sports law firm CRESTA about the consequences of the COVID-19 outbreak on contracts between players/coaches and clubs.

It is the main concern of people when they contact us on social media and WhatsApp. They want to know if clubs can ‘cut salaries’, ‘end contracts’ or release the ITC of players because of the COVID-19 outbreak” comments Xavier Mansat.

In principle, without just cause or the agreement of players, none of the above can happen. A situation of force majeure may, however, affect the contractual relationship. Subject to the relevant national legislation, this concept is widely accepted as referring to an irresistible, unpredictable and external event.

Is the COVID-19 outbreak a situation of force majeure then? Circumstances specific to each case –e.g. public authority decisions, the status of the competitions, etc.) must be assessed in order to answer that question. Its irresistible character -the outbreak causes the absolute impossibility to execute the contract is likely to be the most debated topic.

In any case, players must not sign, accept nor do anything prior to having asked a legal counsel for a professional opinion about their current situation.

Xavier Mansat concludes with a warning for both clubs and players. In the event the competitions would start again, the automatic release of players with an ITC after May 15 -an FIVB rule- will have to be dealt with. Failing to do so, these players will not be allowed to play. A topic to be certainly discussed with the FIVB, the only volleyball governing body able to lengthen the transfer period.

Re: @boscoscuro
I have NO idea why A1 leadership even thinks they have chance to play again? Many of the foreign left already and no way are they coming back for a modified playoff, even if they wanted to.
Players would need significant time to get in game shape and then you run the risk of injury. Pay your staff and players , wish them well and send them on their way.
